Where do business partnerships go wrong?

On Behalf of | Sep 2, 2025 | Business Law

If you are thinking of becoming a business partner with one or more others, then it is crucial to understand where potential problems might lie. This is crucial regardless of whether you own a company and are looking to take on a partner, someone else with a business wants to bring you on board or you are considering starting a new business with someone.

Problems can not only put a damper on your enthusiasm, but they could mean your time, money and effort go to waste.

Areas of dispute

Here are some areas where partnerships often encounter problems.

The balance of power: Who gets to make the decisions when an agreement cannot be reached? You cannot rely on you all agreeing on everything, so it is important to think about how you will handle disparities of opinions. It’s perhaps even more important where there are more than two partners, as split opinions are more likely.

The balance of reward: It’s important to make sure all partners feel appropriately rewarded for their contributions. Tensions can arise when the rewards seem unfairly shared out. For example, problems could arise if someone who invested money but little else takes away a larger or similar cheque to those who are doing the hard work.

Poor communication: Business partners need to communicate clearly; otherwise, things could fall through the gaps. It is also easy for things to go unsaid for fear of upsetting the other person, resulting in issues festering. Or for someone to get offended when one has a more direct style of communication than the others.

Building an effective business partnership starts with a careful choice of who to partner with and a solid contract to document the relationship. Legal guidance can be of great help in setting things up.
